In recent decades, the problem of post-truth has emerged. Values such as fairness, objectivity, and critical dialogue have become more difficult to achieve. Various characteristics are associated with this, such as the emergence of new technologies and a new era in political relations with the rise of fundamentalism and populism. Besides, the reference to postmodernism is always commonplace in the bibliography on the subject. Considering this, the article’s main objective is to philosophically analyze the theoretical foundation of post-truth, postmodernism. From (...) the methodological point of view, this theoretical study will take the interpretive approach as a reference. Interpretive hermeneutical criticism has been combined with a documentary analysis of the main works that address this problem. The article explains the main characteristics of the concept, considering the current and notorious interpretation, and then interprets the position that criticizes postmodernism as the theoretical basis of the post-truth era. It concludes by defining that the relationship between post-truth and its theoretical foundation has a dogmatic and contradictory character since it confronts subjectivist relativism with the dogma of a realist metaphysics. El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their (...) neighbors to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. El presente texto busca difundir a un público más amplio el pensamiento del escritor e intelectual peruano Manuel González Prada (1844-1918), uno de los introductores del positivismo y del anarquismo en el Perú, quien ejerció una notable influencia sobre varios pensadores y literatos peruanos de comienzos del siglo XX, como José Carlos Mariátegui, Víctor Raúl Haya de la Torre, César Vallejo, Jorge Basadre, entre otros. En ese sentido, mostraremos los juicios e ideas de Gonzalez Prada referidas a la (...) relación entre saber científico y poder político, enmarcado en un proyecto de emancipación social y cultural. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. There can be no doubt that discrimination based on sex, race, ethnicity, religion or beliefs should not be tolerated in academia. Surprisingly, however, in recent years, policies of Diversity, Inclusion and Equity(DIE), officially introduced to counteract discrimination, have increasingly led to quite the opposite result: the exclusion of individuals who do not share a radical 'woke' ideology on identity politics (feminism, other gender activisms, critical race theory, etc.), and to the suppression of the academic freedom to discuss such dogmas. Mimesis can refer to imitation, emulation, representation, or reenactment - and it is a concept that links together many aspects of ancient Greek Culture. The Western Greek bell-krater on the cover, for example, is painted with a scene from a phlyax play with performers imitating mythical characters drawn from poetry, which also represent collective cultural beliefs and practices. One figure is shown playing a flute, the music from which might imitate nature, or represent deeper truths of the cosmos based upon (...) Pythagorean views (which were widespread in Western Greece at the time). The idea that mimesis should be restricted to ideals was made famous by Plato (whose connections to Pythagoreanism and Siracusa are well-known), and famously challenged by his student Aristotle (not to mention by the mimetic character of Plato’s own poetry). Há uma vinculação direta entre democracia, cidadania e direitos humanos. Uma sociedade será mais democrática à medida que os direitos de cidadania se ampliarem para uma quantidade maior de seus membros. Nesse sentido, qual é o critério utilizado para definir o grau de expansão da cidadania em uma sociedade? • Cidadania Com base na trajetória histórica inglesa, o sociólogo T. H. Marshall2 estabeleceu uma divisão dos direitos de cidadania em três estágios. O primeiro ocorre com a conquista dos direitos civis (...) (garantia das liberdades individuais, como a possibilidade de pensar e de se expressar de maneira autônoma), da garantia de ir e vir e do acesso à propriedade privada. A conquista desses direitos foi influenciada pelas ideias iluministas e resultou da luta contra o absolutismo monárquico do Antigo Regime. Esse processo teve como resultado maior o advento da isonomia, ou seja, da igualdade jurídica. O direito de ser tratado com equidade é um exemplo de direito civil. O segundo estágio refere-se aos direitos políticos, entendidos como a possibilidade de participação da sociedade civil nas diversas relações de poder presentes em uma sociedade, em especial a possibilidade de escolher representantes ou de se candidatar a qualquer tipo de cargo, assim como de se manifestar em relação a possíveis transformações a serem realizadas. Os direitos políticos têm relação direta com a organização política dos trabalhadores no final do século XIX. Ao buscar melhores condições de trabalho, eles se utilizaram de mecanismos da democracia – por exemplo, a organização de partidos e sindicatos – como modo de fazer valer seus direitos. Por fim, o terceiro estágio corresponde aos direitos sociais vistos como essenciais para a construção de uma vida digna, tendo por base padrões de bem- estar socialmente estabelecidos, como educação, saúde, lazer e moradia. Esses direitos surgem em decorrência das reivindicações de diversos grupos pela melhora da qualidade de vida. É o momento em que cidadãos lutam por melhorias no sistema educacional e de saúde pública, pela criação de áreas de lazer, pela seguridade social etc. O direito de organização política é um exemplo de direito político. Na imagem, manifestação de estudantes em frente ao Palácio de La Moneda, sede do governo chileno, contra as mudanças no sistema educacional do país. Santiago (Chile, 2014). Por ter sido construída tendo como referência o modelo inglês, a tipologia cronológica de Marshall recebeu críticas ao ser aplicada como modelo universal. Ao longo desse percurso, muitas constituições, como a estadunidense (1787) e a francesa (1791), preconizaram o respeito aos direitos individuais e coletivos, o que hoje é incorporado pelas instituições de diversos países. Podemos destacar outras iniciativas que tinham o mesmo objetivo, como a Declaração dos Direitos do Homem e do Cidadão (1789) e a Declaração Universal dos Direitos Humanos (1948). O direito à moradia é um exemplo de direito social no Brasil. No entanto, ele não é garantido para a maioria da população. De acordo com Marshall, cidadão é aquele que exerce seus direitos civis, políticos e sociais de maneira efetiva. Percebe-se que o conceito de cidadania está em permanente construção, pois a humanidade se encontra sempre em luta por mais direitos, maior liberdade e melhores garantias individuais e coletivas. Ser cidadão, portanto, significa ter consciência de ser sujeito de direitos – direito à vida, ao voto, à saúde, enfim, direitos civis, políticos e sociais. A ideia de direitos humanos têm como contrapartida a de deveres, uma vez que os direitos de um indivíduo são condicionados ao cumprimento de seus deveres. O Estado, por sua vez, tem o dever de garantir os direitos humanos, protegendo-os contra violações (embora, em muitos casos, ele próprio as cometa, desrespeitando a Constituição). No Brasil, a extensão dos direitos de cidadania é bastante restrita. Apenas uma parcela da população tem acesso aos direitos básicos. Diversos grupos têm seus direitos violados constantemente. Exemplos disso são os casos de violência contra a mulher, que muitas vezes são ignorados ou minimizados pela sociedade e pelo Estado. A violência contra a mulher é um exemplo de violação dos direitos e da negação de cidadania. Na imagem, cartaz de campanha, veiculada em 2014, que mostra que muitas mulheres sofrem com essa violência ao redor do mundo. • Direitos Humanos A ideia de direitos humanos como algo extensivo a todos os indivíduos surgiu após a Segunda Guerra Mundial, diante das barbaridades e efeitos destrutivos produzidos pelo conflito. A Declaração Universal dos Direitos Humanos foi aprovada em 10 de dezembro de 1948 pela ONU, criada em 1945 com o objetivo de proporcionar o diálogo e impedir conflitos entre os países por questões políticas, econômicas ou culturais. A Declaração teve por base os direitos essenciais à vida e à liberdade e o reconhecimento da pluralidade como meio de combater ações disdiscriminatória. Uma série de tratados internacionais de direitos humanos e outros instrumentos adotados desde 1945 expandiram o corpo do direito internacional sobre os direitos humanos. Eles incluem a Convenção para a Prevenção e a Repressão do Crime de Genocídio (1948), a Convenção Internacional sobre a Eliminação de Todas as Formas de Discriminação Racial (1965), a Convenção sobre a Eliminação de Todas as Formas de Discriminação contra as Mulheres (1979), a Convenção sobre os Direitos da Criança (1989), a Convenção sobre os Direitos das Pessoas com Deficiência (2006), entre outras. Os direitos humanos são valores que visam ao respeito mútuo em detrimento dos privilégios restritos a determinados grupos, por isso não devem ser pensados como benefícios particulares ou privilégios de grupos elitizados. Como sabemos, a simples declaração de um direito não faz necessariamente que ele seja implementado na prática, mas abre espaço para sua reivindicação. Uma das características básicas dos direitos humanos é o fato de estabelecerem que a injustiça e a desigualdade são intoleráveis. É preciso perceber que os indivíduos não são apenas beneficiários no processo histórico de afirmação dos direitos humanos, mas também autores responsáveis pela construção e pela reivindicação da expansão e da garantia desses direitos. Todas as conquistas relacionadas aos direitos humanos são resultado de processos históricos, das mobilizações e de demandas da população. A prática de esportes e o lazer são direitos essenciais para a formação adequada da juventude. Entretanto, falhas na atuação do Estado nem sempre permitem que os jovens tenham acesso a esses direitos. Na imagem, crianças jogam futebol à beira- mar na Praia Redonda em Icapuí (CE, 2014). Assim, as lutas por igualdade e liberdade ampliaram os direitos políticos e abriram espaços de reivindicação para a criação dos direitos sociais, dos direitos das chamadas “minorias” – mulheres, idosos, negros, homossexuais, jovens, crianças, indígenas – e do direito à segurança planetária, simbolizado pelas lutas ecológicas e contra as armas nucleares. Já as lutas populares por participação política ampliaram os direitos civis: direito de opor-se à tirania, à censura, à tortura; direito de fiscalizar o Estado por meio de associações, sindicatos ou partidos políticos; direito à informação sobre as decisões governamentais. A divisão entre direitos civis, políticos e sociais não deve nos levar a perder de vista uma característica intrínseca aos direitos humanos: sua indivisibilidade. Isso equivale a dizer que os direitos não podem ser exercidos de maneira parcial. Todas as pessoas devem gozar do conjunto total de direitos e de cada um na sua totalidade. De acordo com a Declaração e Programa de Viena, de 1993, todos os direitos humanos são universais, indivisíveis, interdependentes e inter-relacionados. Portanto, devem ser tratados de modo global, justo e equitativo. Embora as características específicas de local, contexto e cultura precisem ser levadas em consideração, é dever do Estado promover e proteger todos os direitos humanos de maneira integral, independentemente de qual seja seu sistema político, econômico e cultural. A tragédia nasceu de tais circunstâncias, culminando seu apogeu no século V a.C., com as peças de Ésquilo*3 (525-456a.C.), SÓFOCLES*4 (496/4-406 a.C.) e Eurípedes*5 (480-406 a.C.). Pode-se dizer que, contrário (...) ao que ocorre normalmente, a arte não se deixou preceder pela filosofia, pois os poetas eram filósofos, pensando com sua própria mente e constituindo-se na vanguarda intelectual do seu tempo. -/- SÓFOCLES, em 468 a.C., ganhou do já consagrado Ésquilo, seu primeiro prêmio de tragédia, quando tinha vinte e sete anos. Ele nasceu em Colono, nas imediações de Atenas, filho de fabricante de espadas, que, com as guerras da Pérsia e do Peloponeso, aumentou seus serviços consideravelmente, enriquecendo a família. Não obstante, os demais atenienses empobreceram miseravelmente. SÓFOCLES era considerado bonito, inclusive sua estátua, que o representa na velhice, indica-lhe como um vigoroso homem. Era muito habilidoso em tudo o que fazia, tanto nas tragédias, como nas guerras e nos esportes. -/- Foi contemporâneo e amigo de Péricles*6 (495-429 a.C.), grande líder de Atenas, que lhe 6 ajudou a ocupar altos cargos, como o de tesoureiro e general, em 443 a.C. Em 440 a.C., encontrava-se entre os generais e comandantes das forças atenienses contra Pomos. Foi, ainda, membro do Comitê de Segurança Pública, votando a favor da Constituição oligárquica, em 411 a.C. Exerceu, também, funções de sacerdote. Era um homem alegre e amante dos prazeres, emanando encanto e simpatia, que lhes faziam perdoar os erros, envolvido com rapazes e cortesãs, inclusive teve um filho da célebre hetera Têoris.*7 Foi também contemporâneo de Eurípedes, ainda que nascido bem antes deste, mas ambos morreram no mesmo ano, em 406 a.C. -/- SÓFOCLES escreveu cento e treze peças, das quais só nos chegaram sete, nesta ordem de procedência, Ajax (c. 445 a.C.) As Traquínias (c. 445 a.C.), Antígona (c. 442), Édipo Rei (c. 425), Electra (c. 415), Filoteuto (409) e Édipo em Colono (401). Ganhou o primeiro prêmio de teatro, por dezenove vezes, tendo vinte e sete anos na primeira, e oitenta e cinco, na última. Governou o teatro ateniense por mais de trinta anos, da mesma maneira que seu amigo Péricles governava Atenas. -/- Escreveu uma trilogia não intencional, com as tragédias Édipo Rei (425 a.C.), Édipo em Colono (401 a.C.) e Antígona (442 a.C.). A primeira foi o mais famoso dos dramas gregos, tendo uma abertura impressionante, com a população diante do palácio real de Tebas. Havia uma peste que assolava a cidade, e isso os oráculos identificaram como decorrência de um grande crime. A clássica narrativa tratava de um filho, Édipo, que inadvertidamente matara o pai, Laio, e se casara com a mãe, Jocasta, com a qual teve quatro filhos: Antígona, Polinice, Etéocles e Ismênia. Quando tudo fora descoberto, Jocasta se enforcara e Édipo, enlouquecido, arrancara os próprios olhos e abandonara Tebas, partindo para o exílio em companhia apenas de Antígona. Já em Édipo em Colonos, este estava envelhecido a mendigar em Colono, perto de Atenas, apoiado apenas pela filha. -/- Antígona foi a última peça da trilogia, ainda que tenha sido a primeira a ser escrita. Ao tomar conhecimento de que seus irmãos Polinice e Etéocles estavam em guerra pelo trono de Tebas, regressou apressada para tentar apaziguá-los. Não obstante, eles lutaram até a morte. Creonte aliado de Etéocles, tomou o reino e puniu a rebeldia de Polinice, proibindo que fosse sepultado. Antígona, evocando a crença de que o espírito de um morto só se livrava das torturas da morte depois do corpo ser enterrado, violou o decreto de Creonte e sepultou seu irmão Polinice. Houve, então, o conflito entre as leis dos homens com as leis dos deuses, optando ela por esta, como esperavam as pessoas dignas de se comportarem. Antígona foi condenada pelo tio a ser enterrada viva, colocada em uma catacumba. Seu noivo, Hêmam, filho de Creonte, que desaparecera quando ela desobedecera o decreto real, voltou e encontrou sua prometida morta, suicidando-se em seguida.*8 O drama era denso em todos os seus elementos, mas se elevava quando discutia o comportamento que o cidadão devia ter frente às leis opressivas. -/- 2 DESOBEDIÊNCIA CIVIL: RECUSA DE ANTÍGONA -/- Antígona e sua irmã Ismênia representavam, respectivamente, os símbolos de resistência à tirania e de obediência à razão, colocando a lei de Creonte frente à lei da justiça. Diante do édito que impedia Antígona de sepultar Polinice, considerava a existência do direito natural de enterrá-lo, sendo este o seu drama político. Devia obedecer às leis da polis ou da consciência e dos princípios religiosos? Este drama é representado pelo magnífico texto de SÓFOCLES, quando Creonte perguntou se Antígona tripudiava sobre suas leis. Antígona lhe respondeu que: -/- “Essas leis não foram promulgadas por Zeus, nem mesmo a Justiça, que convive com os deuses do inferno, foi a que estabeleceu tais princípios para os homens. Ele ainda afirmou que os anúncios das leis de Creonte não tinham o poder que eles imaginavam que o tinha, e que um simples mortal pudesse suplantar os preceitos, não escritos e imutáveis dos deuses. Antígona ainda afirma que tais preceitos não foram de hora, como também não fora de ontem, mas que sempre vigoraram no mundo sensível, e que ninguém sabia ao certo de sua existência. Antígona afronta Creonte dizendo que por causa das leis do mesmo, não queria ser ela castigada perante os deuses por ter, de alguma forma, medo da ira e afronta de um reles mortal. Ainda diz que sua morte é algo inevitável, uma vez que é a única certeza dos homens, e que ela há de vir em um tempo, pois isso não se pode ignorar, todavia se sua morte não a tivesse sido anunciada antes, e que com isso morrera antes do tempo, o tomaria como vantagem, uma vez que, submetido as mais variadas intempéries da vida, como não iria considerar sua morte um benefício? E com isso, essa dor de nada vale no tocante de seu destino. Antígona continua dizendo que em nada o afeta ao ver o cadáver do filho morto de sua mãe na condição de insepulto, uma vez que isso não lhe causa dor . O mesmo conclui dizendo que se achara que ele cometera um ato de loucura após a proclamação de sua resposta, talvez o achasse louco aquele que viera a condená-lo.”*9 -/- O conflito entre a lei positiva, enunciava o drama grego, e a lei natural, significava que esta identificava-se com a Justiça dos deuses, que era superior à lei da terra.*10 Para Antígona, aquela deveria sempre prevalecer, mas a sua morte representou o triunfo, mesmo que trágico, da lei da polis.*11 SÓFOCLES foi quem primeiro falou do direito de resistência, inclusive com a possibilidade de se sofrer uma grave sanção, como ocorreu com Antígona, e ainda assim sabendo suportar a dor.*12 A teoria não logrou desenvolvimento na Grécia antiga, nem na teoria política antiga. In Brazil, the social demand for veterinary expertise is growing. However, there is still a shortage of professionals trained in this area to apply specific knowledge to each case. Studies and research into forensic veterinary medicine are necessary for veterinary experts to assist in investigations and legal proceedings. Veterinary medicine has subjects on its curriculum that cover the knowledge needed to apply in the fields of animal health, public health and the environment. The interaction between human and veterinary medicine, as (...) well as other areas of health, is of great importance in the prevention and control of various diseases, both in animals and humans. Some cases of infectious bovine abortion have a major impact not only on cattle farming and animal health, but also on public and environmental health. The concept of "One Health" integrates human medicine and health professionals. In this context, knowledge of infectious abortive diseases that affect animal, human and environmental health is fundamental. Cattle are affected by specific infectious abortive diseases, caused by pathogens with different forms of presentation and transmission mechanisms. These include brucellosis, leptospirosis and listeriosis, which are potentially zoonotic diseases. Controlling these diseases can contribute to effective public health actions and reduce global health risks. In order to establish the diagnosis of these diseases, it is essential to properly collect specimens from live or dead animals under biosafety and biosecurity conditions, following the chain of custody for each case. These procedures allow for greater success in diagnosing the suspected agent and facilitate the investigation of other causes. Animal health standards for the prophylaxis and control of these diseases are established by specific legislation, including those of the Ministry of Agriculture, Livestock and Supply (MALS). This literature review was based on current knowledge on the Pubmed platform, Google Scholar, articles and textbooks. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. Are norms of inquiry in tension with epistemic norms? I provide a (largely) negative answer, turning to a picture of epistemic practices as rule-governed games. The idea is that, while epistemic norms are correctness standards for the attitudes involved in epistemic games, norms of inquiry derive from the aims of those games. Attitudes that, despite being epistemically correct, are inadvisable regarding the goals of some inquiry are just like bad (but legal) moves in basketball or chess. I further consider cases (...) in which the aims of inquiry recommend breaking epistemic norms. I compare them to strategic infractions, which are common in many coherent games. Finally, I explore the connections between rules and aims in games and in inquiry. I show that in both cases respecting the rules is constitutively required for satisfying the aims of the practice. This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, coercively enforced, (...) hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. El Realismo Especulativo, Nuevo Realismo o Realismo Postcontinental es una corriente ecléctica que viene a superar las aporías e insuficiencias de la filosofía continental desde una perspectiva a la que se le podrían achacar los mismos problemas que la perspectiva idealista y constructivista de los filósofos continentales. Para el desarrollo de la filosofía es importante entablar conversación los autores de este movimiento. En el presente artículo se presenta una aproximación a los aciertos e insuficiencias de las ontologías de dos autores (...) de la corriente como son Markus Gabriel y Graham Harman. Se presentan los aciertos e insuficiencias del realismo neutro de Markus Gabriel y de la Ontología Orientada a los Objetos, en este orden. En el último epígrafe, a modo de conclusiones, se señalan los puntos en común de las ontologías y se aporta la idea de acontecimiento como línea de investigación que supere las aporías que emergen de la contraposición entre el idealismo y realismo. Our pains can be more or less intense, our mental imagery can be more or less vivid, our perceptual experiences can be more or less striking. These degrees of intensity of conscious experiences are all manifestations of a phenomenal property I call mental strength. In this article, I argue that mental strength is a domain-general phenomenal magnitude; in other words, it is a phenomenal quantity shared by all conscious experiences that explains their degree of felt intensity. Mental strength has been (...) largely overlooked in favor of mental states’ type, representational contents, domain-specific phenomenology, or processes such as attention. Considering mental strength in our reflections about the mind illuminates debates about the relation of representational contents and phenomenal character, and it also helps address questions about the structure and functions of consciousness. Mental strength provides a unifying construct to model what is shared in the phenomenology of different types of conscious experiences. (shrink)

Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. Arguably the most foundational principle in perception research is that our experience of the world goes beyond the retinal image; we perceive the distal environment itself, not the proximal stimulation it causes. Shape may be the paradigm case of such “unconscious inference”: When a coin is rotated in depth, we infer the circular object it truly is, discarding the perspectival ellipse projected on our eyes. But is this really the fate of such perspectival shapes? Or does a tilted coin retain (...) an elliptical appearance even when we know it’s circular? This question has generated heated debate from Locke and Hume to the present; but whereas extant arguments rely primarily on introspection, this problem is also open to empirical test. If tilted coins bear a representational similarity to elliptical objects, then a circular coin should, when rotated, impair search for a distal ellipse. Here, nine experiments demonstrate that this is so, suggesting that perspectival shapes persist in the mind far longer than traditionally assumed. Subjects saw search arrays of three-dimensional “coins,” and simply had to locate a distally elliptical coin. Surprisingly, rotated circular coins slowed search for elliptical targets, even when subjects clearly knew the rotated coins were circular. This pattern arose with static and dynamic cues, couldn’t be explained by strategic responding or unfamiliarity, generalized across shape classes, and occurred even with sustained viewing. Finally, these effects extended beyond artificial displays to real-world objects viewed in naturalistic, full-cue conditions. We conclude that objects have a remarkably persistent dual character: their objective shape “out there,” and their perspectival shape “from here.”. (shrink)

Abstract. Following the tracks of Ryle and based upon the theory of complex systems, we shall develop a characterization of action-based consciousness as an embodied, embedded, selforganized process in which action and dispositions occupy a special place. From this perspective, consciousness is not a unique prerogative of humans, but it is spread all around, throughout the evolution of life. We argue that artificial systems such as robots currently lack the genuine embodied embeddedness that allows the type of self-organization that is (...) relevant to consciousness. -/- Sommario. Seguendo la linea tracciata da Ryle e basata sulla teorie dei sistemi complessi, svilupperemo una caratterizzazione della coscienza basata sull’azione come un processo incarnato, situato e auto organizzante nel quale le azioni e le disposizioni occupano un ruolo decisivo. Da questo punto di vista, la coscienza non è una prerogativa esclusiva degli esseri umani, ma è diffusa nel mondo naturale grazie ai processi evolutivi. When a circular coin is rotated in depth, is there any sense in which it comes to resemble an ellipse? While this question is at the center of a rich and divided philosophical tradition (with some scholars answering affirmatively and some negatively), Morales et al. (2020, 2021) took an empirical approach, reporting 10 experiments whose results favor such perspectival similarity. Recently, Burge and Burge (2022) offered a vigorous critique of this work, objecting to its approach and conclusions on both philosophical (...) and empirical grounds. Here, we answer these objections on both fronts. We show that Burge and Burge’s critique rests on misunderstandings of Morales et al.’s claims; of the relation between the data and conclusions; and of the philosophical context in which the work appears. Specifically, Burge and Burge attribute to us a much stronger (and stranger) view than we hold, involving the introduction of “a new entity” located “in some intermediate position(s) between the distal shape and the retinal image.” We do not hold this view. Indeed, once properly understood, most of Burge and Burge’s objections favor Morales et al.’s claims rather than oppose them. Finally, we discuss several questions that remain unanswered, and reflect on a productive path forward on these issues of foundational scientific and philosophical interest. (shrink)

In this chapter, we discuss a selection of current views of the neural correlates of consciousness (NCC). We focus on the different predictions they make, in particular with respect to the role of prefrontal cortex (PFC) during visual experiences, which is an area of critical interest and some source of contention. Our discussion of these views focuses on the level of functional anatomy, rather than at the neuronal circuitry level. We take this approach because we currently understand more about experimental (...) evidence at this coarse level and because these results are appropriate for arbitrating between current theoretical frameworks. We discuss the Two-Visual-Systems Hypothesis (Milner & Goodale 1995; 2006), Local Recurrency (Lamme 2010; Lamme 2006), Higher Order (Lau 2008; Lau & Rosenthal 2011) and Global Workspace theories (Baars 1997; Baars 2005; Dehaene & Naccache 2001; Dehaene 2014). Despite the apparent stark differences between conscious and unconscious perceptual processing, available evidence suggests that their neural substrates must be largely shared. This indicates that the difference in neural activity between conscious and unconscious perceptual processing is likely to be subtle and highly specialized. We argue that current experimental evidence about the involvement of specific activity in prefrontal cortex supports the higher order neural theory of consciousness. In consequence, imaging techniques that focus only on marked differences between conscious and unconscious level of activity are likely to be insensitive to the relevant neural activity patterns that underlie conscious experiences. Finally, it follows from the evidence we discuss that the functional advantages of conscious over unconscious perceptual processing may be more limited than commonly thought. (shrink)

Introspection is a fundamental part of our mental lives. Nevertheless, its reliability and its underlying cognitive architecture have been widely disputed. Here, I propose a principled way to model introspection. By using time-tested principles from signal detection theory (SDT) and extrapolating them from perception to introspection, I offer a new framework for an introspective signal detection theory (iSDT). In SDT, the reliability of perceptual judgments is a function of the strength of an internal perceptual response (signal- to-noise ratio) which is, (...) to a large extent, driven by the intensity of the stimulus. In parallel to perception, iSDT models the reliability of introspective judgments as a function of the strength of an internal introspective response (signal-to-noise ratio) which is, to a large extent, driven by the intensity of conscious experiences. Thus, by modelling introspection after perception, iSDT can calibrate introspection’s reliability across a whole range of contexts. iSDT offers a novel, illuminating way of thinking about introspection and the cognitive processes that support it. By elaborating on the results presented in Lógica cuántica, Nmatrices y adecuación I, here we discuss the notions of adequacy and truth functionality in quantum logic from the point of view of a non-deterministic semantics based on Nmatrices. We present a proof of the impossibility of providing a functional semantics for the quantum lattice. An advantage of our proof is that it is independent of the number of truth values involved, generalizing previous works. Due to the impossibility of defining adequate (...) interpreting sets for the conjunction and disjunction (as was shown in our previous work), it follows that a homomorphism between the lattice of quantum projections and a Boolean algebra of n-elements cannot exist. In this short note we develop an unorthodox panmentalistic and libertarian dualism. Especially we skech a mental-physikal law of free will. Our aim is to to provoke the contemporary scentific common-sense.

The question of how we should engage with a philosopher’s racial thought is of particular importance when considering Kant, who can be viewed as particularly representative of Enlightenment philosophy. In this article I argue that we should take a stance of deep acknowledgment when considering Kant’s work both inside and outside the classroom. Taking a stance of deep acknowledgment should be understood as 1) taking Kant’s racial thought to be reflective of his moral character, 2) Kant being accountable for his (...) racial thought and 3) being willing to consider the possibility that Kant’s racial thought is consistent with and inextricable from his moral philosophy. Alternative forms of engaging with Kant’s racial work have either moral or pedagogical failings, which range from simply teaching the history of philosophy uncritically to outright deception. A stance of deep acknowledgement will allow philosophers to understand how Kant’s racial thought interacts with his moral philosophy and allow instructors to teach philosophy in a historically contextualized approach so as to not alienate students whose demographic was disparaged by Kant. Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. The purpose of this text is to present a reading of the concept of motherhood that reveals the chains that identify it with a myriad of falsely natural gender roles. Based on the work of other women who compiled testimonies narrating different experiences around motherhood, to show that the understanding of this concept allows for motherhood to be lived within the acknowledgement and acceptance of said gender roles, even if they place mothers in a situation of oppression.

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Metacognition is the capacity to evaluate the success of one's own cognitive processes in various domains; for example, memory and perception. It remains controversial whether metacognition relies on a domain-general resource that is applied to different tasks or if self-evaluative processes are domain specific. Here, we investigated this issue directly by examining the neural substrates engaged when metacognitive judgments were made by human participants of both sexes during perceptual and memory tasks matched for stimulus and performance characteristics. By comparing patterns (...) of fMRI activity while subjects evaluated their performance, we revealed both domain-specific and domain-general metacognitive representations. Multivoxel activity patterns in anterior prefrontal cortex predicted levels of confidence in a domain-specific fashion, whereas domain-general signals predicting confidence and accuracy were found in a widespread network in the frontal and posterior midline. The demonstration of domain-specific metacognitive representations suggests the presence of a content-rich mechanism available to introspection and cognitive control. (shrink)

The “received view” on Kantian ethics holds that perfect duties enjoy absolute priority over imperfect duties. More recently, several Kantian scholars have reassessed this situation, arguing that imperfect duties may remain binding even if they imply breaching a perfect duty. In this article, I argue that both positions rely on a misunderstanding of the bindingness of Kantian duties. Genuine Kantian duties, I claim, remain binding even when they cannot be fulfilled. We must always strive for a total completion of our (...) duties; what it means for us to strive for it, however, will vary depending on our peculiar situation. (shrink)

In this article, I deal with Searle’s philosophy of society, the last step to complete his philosophical system. This step, however, requires an examination of the context and presuppositions, or default positions, that make possible the key concepts of this new branch of philosophy. In the first section, I address what the enlightenment vision implies. The second section focuses upon how consciousness and intentionality are biological tools that help us create and maintain the social world. In the third section, I (...) explain the importance of the difference between subjectivity and objectivity. Finally, in the fourth section I elaborate upon the default positions: the existence of one world, truth as correspondence to facts, direct perception, meaning, and causation. Importantly, I show how the context and presuppositions of the philosophy of society are an opportunity of interdisciplinary work between philosophy and the social sciences. (shrink)

Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. Studying the neural correlates of conscious awareness depends on a reliable comparison between activations associated with awareness and unawareness. One particularly difficult confound to remove is task performance capacity, i.e. the difference in performance between the conditions of interest. While ideally task performance capacity should be matched across different conditions, this is difficult to achieve experimentally. However, differences in performance could theoretically be corrected for mathematically. One such proposal is found in a recent paper by Lamy, Salti and Bar-Haim [Lamy (...) D, Salti M, Bar-Haim Y. Neural correlates of subjective awareness and unconscious processing: an ERP study. J Cognitive Neurosci 2009,21:1435-46], who put forward a corrective method for an electroencephalography experiment. We argue that their analysis is essentially grounded in a version of High Threshold Theory, which has been shown to be inferior in general to Signal Detection Theory. We show through a series of computer simulations that their correction method only partially removes the influence of perfor- mance capacity, which can yield misleading results. We present a mathematical correction method based on Signal Detection Theory that is theoretically capable of removing performance capacity confounds. We discuss the limitations of mathemati- cally correcting for performance capacity confounds in imaging studies and its impact for theories about consciousness. (shrink)

This article focuses on an Ethno philosophy through intercultural philosophy and dialogue. This philosophical reflection stands on an historical, cultural and ethical subject known as “us” in the Latin American experience. From an intercultural dialog and its philosophy, there will be an approach of Ethno philosophy as a new way of thinking and doing philosophy from interculturalism, the recovery of ancestral knowledge and the dialogue of different forms of knowledge from the diversity of worldviews of different cultures and ethnic groups.

In the present essay, I trace the way in which Derrida engages the theme of the destruction of philosophy in his reading of Heidegger’s work in the 1964-65 seminar, Heidegger: The Question of Being and History. Specifically, I focus on a close reading of the first three sessions in order to show the way in which the theme of the destruction of philosophy appears in relation to the posing of three questions, namely, the questions of being, history, and metaphor. In (...) all three sessions, I will show that the questions of being, history, and metaphor allow Heidegger, according to Derrida, to brush against the very limits of philosophy. However, Derrida’s own interpretation reveals an interesting emphasis on the destruction of philosophy that, while definitely inspired by Heidegger, slightly begins to go beyond him. For this reason, I will turn to his more critical appraisal of Heidegger’s trajectory in the final two sessions. In so doing, I claim that Derrida’s positions in these final sessions will show a critical distance vis-à-vis Heidegger that will foreshadow the very question that will remain decisive throughout his nearly 40 year engagement with Heidegger’s work, namely, the question of difference. Analytic philosophy of language has often criticized classical pragmatism for holding to an unwarranted notion of experience which lapses into epistemological foundationalism; defenders of the classics have denied such a consequence. The paper tries to move this debate forward by pointing out that the criticism of the empiricist “given” is not wedded to a specific philosophical method, be it linguistic or pragmatist. From a broader historical perspective drawing in particular on Kant, antifoundationalism turns out to be deeply rooted in modern (...) western philosophy and its ambivalent attitude towards the success of the empirical sciences. This diagnosis allows to reassess classical pragmatism beyond the perceived alternative “language vs. experience”, and to concentrate on antifoundationalism as the real challenge to any modern, epistemologically oriented philosophy. In that perspective, classical pragmatism’s genuine contribution is to do justice to antifoundationalism by focusing on the experimental dynamic of scientific practice, which is most commonly ignored by the analytic tradition. Pragmatism identifies rationality with the practical operation of reflexively determining and articulating what is being experienced. With this approach, it is argued, experiential pragmatism serves modern antifoundationalism ends better than its analytic siblings. (shrink)

In this paper, I consider the contribution of Geoffrey Bennington's book, _Scatter 1_, to the ongoing discussion of the political dimension of deconstruction. Focusing on the resonances between Bennington's "politics of politics" and the notion of infrapolitics, I suggest that Bennington's major contribution revolves around the introduction of undecidability into political action and thought.

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation.
